2. The petitioner seeks bail in connection with Phulparas P.S. Case No. 397 of 2024, GR No. 35 of 2025 instituted for the offences under Sections 76, 78, 115(2), 126(@), 281, 351(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 8 of the POCSO Act.

3. Prosecution case, in short, is that while the informant's daughter was returning from coaching, the accused

Patna High Court CR. MISC. No.40540 of 2025(3) dt.11-09-2025 2/3 intentionally hit her cycle, snatched her dupatta, assaulted her and threatened to kill her if she spoke about the incident.

4. Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in the present case due to ulterior motives. Learned counsel further submitted that no such occurrence, in the manner as alleged had ever taken place, rather a completely false story has been cooked up at the instance of the rival faction with sole intention to falsely implicate the petitioner with ulterior motives. It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.02.2025 and has five criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that victim in her statement recorded under Section 183 of the Bharatiya Nagarika Suraksha Sanhita, 2023 has supported the case of the prosecution.

6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court
