JUSTICE SUDHIR SINGH ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 324, 307, 504, 506 and 34 of the Indian Penal Code. Allegation against petitioner is that due to land dispute he along with other accused persons assaulted upon informant and his family members.
It has been submitted on behalf of petitioner that he is in custody since 8.6.2016. Chargesheet has been submitted against petitioner. There is no allegation of tampering of witnesses against petitioner. It is a case and counter case between the parties. Both sides have sustained injuries. Petitioner is said to have assaulted Bhupendra Yadav. Nature of injury is simple. Other co-accused has been granted bail vide Cr. Misc. no. 36466 of 2016.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist
