JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Complaint case No. 485 of 2014, disclosing offences under Section 498A of the Indian Penal Code & 3⁄4 of the Dowry Prohibition Act.

Petitioner is the husband of the Opposite party no.2. Learned counsel appearing on behalf of Opposite party no.2 has contended that the petitioner has tortured her variously for demand of dowry. He has further submitted that there is no chance of any amicable settlement between the petitioner and Opposite party No.2. It appears from the allegation as contained

No.31806 of 2015 (2) dt.12-08-2015 in the complaint case which is the basis of the institution of the First Information Report as well as on the basis of submissions made on behalf of the parties that the matrimonial discord between the petitioner and Opposite party no.2 is the real reason behind the institution of the case.

Accordingly, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Patna City in Complaint Case No. 485 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall liable to be cancelled.
