The petitioner apprehends her arrest in connection with Marhaura P.S. Case no. 558 of 2018, registered under Sections 341, 323, 325, 307, 379 and 506/34 of the Indian Penal Code.
The accusation is that on 21.11.2018, at about 9.00 P.M., eight persons named in the F.I.R., including the petitioner, came at the door of the informant Shushila Devi and started to abuse due to land dispute. At that time, Jaipal Rai laid the informant on the ground by catching her hair and caused assault through fist and slaps and petitioner caused injury at the head of informant through iron rod and Prabhawati Devi snatched her golden Mangalsutra and ear ring, when daughter-
Patna High Court CR. MISC. No.40057 of 2019(2) dt.01-07-2019 2/2 in-law of the informant rushed there then she was also assaulted by them.
Learned counsel for the petitioner submits that occurrence of Marpit took place due to land dispute in which petitioner side also sustained injury regarding which Madhowrah P.S. Case No. 562 of 2018, under Section 307 and 323 of the Indian Penal Code is also instituted against the informant and other of the present case. Moreover, the injury as found on the head of informant, which is said to have been caused by the petitioner, kept reserved. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Marhoura P.S. Case No. 558 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
