The petitioner has preferred this application for grant of regular bail in a case registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, information having been received that the accused persons were going to give effect to an occurrence, a raid was conducted, four accused persons including one Ram Kumar was taken into custody and various incriminating articles were recovered from their possession. It is further stated that Ram Kumar in his statement to the police disclosed that one Shajid had informed him that he is going to call Mukhtar and thereafter they would plan and give effect to

It is submitted by learned counsel for the petitioner that even as per the F.I.R. no incriminating material has been recovered from the possession of the petitioner. The only material against him is his name coming in the statement of one of the coaccused. The petitioner is in custody since 8.2.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 11 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Bahadurganj P.S. Case no. 337 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions JudgeII-cum-Special Judge, Excise, Kishanganj.
