JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioners and the State. The petitioners are in custody in a case registered under Section 47(A) of the Excise Act.
The allegation against the petitioners is that huge quantity of liquor was recovered from their house. It is submitted on behalf of the petitioners that the petitioner are in custody since 19.04.2016. The petitioners have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioners. The recovered article belonging to the son of petitioner no.1, the petitioners had no knowledge regarding activity of the son. They have been made accused due to mistake
Patna High Court Cr.Misc. No.26258 of 2016 (3) dt.18-08-2016 2/2 of fact. Other co-accused have been granted bail on 04.07.2016 vide Cr. Misc. No. 25487 of 2016 and on 21.05.2016 vide A.B.P. No. 352 of 2016 by the learned Sessions Judge, Khagaria. On behalf of the State, it is submitted that the petitioners are named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioners, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Beldaur P.S.Case No. 53 of 2016.
