Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint Case No. 276 of 2010 registered for the offences punishable under Section 376 of the Indian Penal Code. Originally, the complainant filed complaint case with specific allegation of rape but in course of inquiry, the learned Magistrate found prima facie case for the offence punishable under sections 376 read with section 511 and 379 of the Indian Penal Code.

No.12344 of 2015 (3) dt.19-05-2015 2/2 Learned counsel appearing for the petitioner submits that the complainant is a lady of questionable character and as a matter of fact petitioner being agnate of the complainant raised objection in respect of the immoral activities of the complainant, the complainant lodged this false case against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Ruxaul, East Champaran in Complaint Case No. 276 of 2010, subject to condition as laid down under Section 438(2) of the Cr.P.C.
