JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-07-2018 It appears that there is some typographical error in the order dated 28.06.2018. Considering the typographical error in the order, today the case has been listed under the heading "To Be Mentioned" for correction in the order dated 28.8.2018. Let the following correction be read in place of para-2 of the said order.
"The petitioners are in custody in connection with Excise Case No. 840 of 2018 arising out of Ara Muffasil P.S. Case No. 155 of 2018 for the offences under Sections 272, 273 IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 2018 Learned counsel for the petitioners submits that the petitioners are in custody since 16.05.2018. They have no
Patna High Court Cr.Misc. No.36596 of 2018(3) dt.03-07-2018 2/2 criminal antecedent. He further submits that similarly circumstanced other co-accused namely, Radha Mohan Singh and others have been granted bail vide order dated 21.6.2018 in Cr. Misc. No. 34517 of 2018.
On the ground of parity, let the petitioners above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of 4th Additional District and Sessions Judge-cum-Special Judge, Excise Act, Bhojpur at Ara, in connection with Excise Case No. 840 of 2018 arising out of Ara Muffasil P.S. Case No. 155 of 2018."
The order dated 28.06.2018 is modified to the aforesaid extent.
