JUSTICE RAJIV ROY ORAL ORDER 02-01-2023 Heard Mr. Vikramdeo Singh, learned counsel for the petitioner and the learned APP for the State. The petitioner apprehends his arrest in connection with Agiaon (Gadhani) P.S. Case No.140 of 2021 instituted under Sections 341,323,290,337,338,307,504,506 and 34 of the Indian Penal Code and 27 of the Arms Act.

As per the FIR, the police party upon information that two named 'Mukhiya' candidates along with their associates are on the verge of fighting due to their political rivalry reached there found some of them were firing. The police was finally able to arrest both the 'Mukhiya' candidates in which the name of petitioner also cropped up.

Learned counsel for the petitioner submits that only because he is supporter of one of the 'Mukhiya' candidate his name has been dragged in the FIR at the instance of the opposite

Patna High Court CR. MISC. No.46287 of 2022(2) dt.02-01-2023 2/2 party. There is no allegation of either firing or causing injury to anyone. His last submission is that he do not have any criminal antecedent.

Learned APP on the other hand opposes the prayer for anticipatory bail.

Taking into account the fact that there is no specific allegation against the petitioner, the case is that the two 'Mukhiya' candidates along with their associates fired, he do not have any criminal antecedent, this Court is inclined to grant him relief.

Let the petitioner be released on bail, in the event of his arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Agiaon (Gadhani) P.S. Case No.140 of 2021 to the satisfaction of learned I/c A.C.J.M., Bhojpur, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
