Petitioner seeks bail in a case registered for the offences punishable under Sections 498A, 323, 354, 504, 506, 420, 379, 120B of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Petitioner is husband of the opposite party no. 2 in a case under Section 498A of the Indian Penal Code. Petitioner is ready for restoration of conjugal life.

The impugned order passed by the learned Additional Sessions Judge-XXI, Patna would reveal that since the

Patna High Court CR. MISC. No.39365 of 2019(2) dt.27-06-2019 2/2 petitioner was not ready to give bond/undertaking that he would keep his wife with full honour and dignity as well as for her security, the prayer for bail was refused.

Considering the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Complaint Case No. 1322(C) of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that at the time of furnishing bail bond, the petitioner shall also file an undertaking on oath that if the opposite party no. 2-wife is ready to live with the petitioner then the petitioner would file bond/undertaking that he would keep his wife with full honour and dignity as well as security.
