JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Ara Nawada Police Station Case No. 411 of 2016 registered for the offences punishable under Sections 323, 420, 406 and 504 of the Indian Penal Code.
The informant initially filed complaint case, which was converted into the present F.I.R., and it is alleged that the informant settled the marriage of his niece (Bhanji) with the petitioner and after engagement (ring ceremony), the petitioner and his family members demanded more dowry and they also did not return the cash and articles given by him at the time of engagement and prior to that.
Patna High Court Cr.Misc. No.44980 of 2016 (2) dt.09-12-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within two months from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Ara Nawada Police Station Case no. 411 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
