The petitioner seeks bail in connection with Siswan (Chainpur O.P) P.S. Case No. 164 of 2016, registered under Sections 272, 273 and 308 of the Indian Penal Code and Section 41 (1) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving secret information regarding selling of illicit liquor in the vehicle near Jash godown, the Police reached there and searched the vehicle bearing Reg. No. BR-29P-5423. On seeing the Police party, the persons who were near the vehicle succeeded to flee away. On search, 672 bottle of 180 ML, 120 bottle of 375 ML total 164 liters of India made foreign liquor recovered and a Smart card
Patna High Court Cr.Misc. No.28103 of 2017 (2) dt.05-07-2017 2/2 has also been recovered from the said vehicle, which disclosed that Amrit Jaiswal (Petitioner) is the owner of the said vehicle. Learned counsel for the petitioner submits that, in fact, the petitioner is the owner of the vehicle, but the said vehicle was plying by the driver and he had no knowledge about carrying of liquor by the driver. The petitioner having no criminal antecedent is in custody since 23.04.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-II, Siwan in connection with Siswan (Chainpur O.P) P.S. Case No. 164 of 2016. (Rajendra Kumar Mishra, J) manish/- U T
