The petitioner seeks bail in Ghorasahan (Jitna) P. S. Case No. 83 of 2019 instituted for the offence under Section(s) 413, 414/34 of the Indian Penal Code. In the written report, it is alleged that petitioner was arrested near Nepal border with 25 new mobile phone of different model and company. It is further alleged in the written report that petitioner along with co-accused Asraf Alam were going towards Nepal with 25 new mobile phones allegedly theft articles which was handed over to the petitioner to be delivered at Nepal by one Hasan Miya of Ghorasahan.
Learned counsel for petitioner submits that that there
Patna High Court CR. MISC. No.37578 of 2019(2) dt.25-06-2019 2/2 is no any case lodged with regard to those mobile phones having been stolen. Petitioner has been arrested merely on suspicion.
Petitioner is in custody since 15.3.2019 having no criminal antecedent..
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM Sikrahana at Motihari, East Champaran in connection with Ghorasahan (Jitna) P. S. Case No. 83 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
