JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 16-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Bettiah Town P.S. Case No. 285 of 2021 instituted for the offences under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the recovery has been made outside the door of the petitioner and 5 liters country made liquor has been recovered alleging it to be ownership of the petitioner which is not possible. I have considered the submissions.

Taking into consideration the nature of allegation prima facie case under Section 30(A) of the Bihar Prohibition

Patna High Court CR. MISC. No.51009 of 2021(2) dt.16-02-2022 2/2 and Excise Act, 2016, is not made out, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
