JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seek bail in connection with Shyampur Bhatha P.S. Case No. 33 of 2017 registered under Sections 30(A), 38 of Bihar Excise Prohibition Act, 2016.

The accusation is that on receiving secrete information about selling of illicit liquor by one Rajnish Kumar in Grocery shop at Village Jhitkari, the police reached there and found that shop was closed from inside and on alarm, one person came out and disclosed his name Rajnish Kumar and on search two cartons, each containing 12 bottles of 750 ml. Indian made foreign liquor, were recovered Rajnish Kumar also disclosed that petitioner used

Patna High Court Cr.Misc. No.27924 of 2017 (2) dt.23-06-2017 to supply the liquor for selling.

Learned counsel appearing on behalf of the petitioner submits that nothing has been recovered from possession of the petitioner. His name has come in the F.I.R. on the basis of confessional statement of co-accused Rajnish Kumar. Petitioner is in custody since 23.04.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge-cum-Special Judge, Sheohar in connection with Shyampur Bhatha P.S. Case No. 33 of 2017. (Rajendra Kumar Mishra, J) sushma/- U T
