Again, I am not inclined to release the petitioner on bail on the ground mentioned by me in my previous order dated 24.11.2016 passed in Cr. Misc. no. 40856/2016. Accordingly, his prayer for bail in connection with Fesar P.S. Case no. 18/2016 pending in the court of Addl. Chief Judicial Magistrate V, Aurangabad stands rejected. However, lower court should commit the case of the petitioner to the court of sessions in accordance with law, if the same has not been committed as yet.
