2. The petitioners have preferred this application for grant of regular bail in connection with Pipariya P.S. Case No. 30 of 2025 dated 21.03.2025 registered for the offences punishable u/s 30(a) and 32 of the Bihar Prohibition and Excise Act and Sections 319(2), 318(4), 303(2), 317(5), 338, 336(3) read with 3(5) of Bhartiya Nyaya Sanhita.
3. The prosecution case in short is that, police intercepted one Innova Car in which petitioners were found sitting. They informed they are coming after the delivery of
Patna High Court CR. MISC. No.39246 of 2025(2) dt.24-06-2025 2/3 illict liquor to one co-accused Chandan Kumar, upon conducting the raid on the Bathan of co-accused Chandan Kumar total 268.5 litres of illicit foreign liquor was recovered.
4. Learned counsel for the petitioners have submitted that the petitioners ar innocent and have falsely been implicated in this case. The petitioners have no concern with the alleged recovery. Nothing has been recovered from the conscious possession of the petitioners. It is submitted that petitioners were driver and co-driver of the said vehicle. The petitioner no. 2 has no criminal antecedent and petitioner no. 1 has one criminal antecedent stated in para 3 of the bail petition. The petitioners are in custody since 21.03.2025.
5. Learned A.P.P. for the State have vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to
Patna High Court CR. MISC. No.39246 of 2025(2) dt.24-06-2025 3/3 the satisfaction of learned Court concerned, in connection with Pipariya P.S. Case No. 30 of 2025.
