The petitioners have preferred this application for grant of regular bail in a case registered under section 379 of the Indian Penal Code to which section 411 of the Indian Penal Code was added subsequently.

As per the prosecution case, the motorcycle of the informant was stolen by unknown accused persons. It is submitted by learned counsel for the petitioners that the F.I.R. was registered against unknown. The name of the petitioners transpired in the statement of spy and the confessional statement of the petitioners before police. It is submitted that no incriminating article has been recovered from

Patna High Court CR. MISC. No.50354 of 2021(2) dt.24-02-2022 2/2 the petitioners possession who have clean antecedents and are in custody since 26.5.2021. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioners not having any criminal antecedent and having remained in custody for more than 8 months, the Court directs the two petitioners to be enlarged on bail in connection with Bounsi P.S. Case no.94 of 2021 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
