JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Mahnar P.S. Case No. 40 of 2014 registered under Sections-304(B) and 201/34 of the Indian Penal Code.
The petitioner happens to be mother-in-law of the deceased who died within two years of her marriage in mysterious condition and the there is allegation of demand of dowry as well as torture against the petitioner. The neighbour of the petitioner claimed that on the alleged date of occurrence, an altercation had taken place in the house of
Patna High Court Cr.Misc. No.4344 of 2015 (4) dt.02-07-2015 2/2 the petitioner. The dead body of the deceased was recovered near a river, kept in a gunny bag.
Considering the aforesaid facts and circumstances as well as submission of the parties, I am not inclined to extent the benefit of privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Mahnar P.S. Case No. 40 of 2014 pending in the court of Learned Chief Judicial Magistrate, Vaishali at Hajipur stands rejected.
However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner. (Hemant Kumar Srivastava, J) A.K.V./- U T
