The petitioner seeks bail in Dumariya P.S. Case No. 33/2016 registered under Sections 302, 201/34 of the Indian Penal Code.

The Chaukidar lodged the case against the petitioner and his family members alleging that he got the information that the petitioner and his family members killed Savitri Devi, who is the daughter of the petitioner, and hurriedly cremated her dead body. Learned counsel for the petitioner submits that the true fact is that Savitri Devi had illicit relation with her own brother-in-law Santan Ram (husband of her elder sister). When the petitioner settled the marriage of his daughter Savitri Devi, Santan Ram (brother-in-law of the deceased) called her on telephone and after killing her hanged her dead body on a tree. It has been referred by

Patna High Court Cr.Misc. No.37269 of 2016 (3) dt.08-11-2016 2/2 the learned Sessions Judge that the witnesses have stated the same facts in different paragraphs of the case diary that Santan Ram killed Savitri Devi and hanged her dead body on a tree. There is no eye witness of the occurrence.

Considering the fact that almost all the witnesses have stated that it was Santan Ram, who had illicit relation with Savitri Devi, called Savitri Devi on phone and after killing her hanged her dead body on a tree, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, District Gaya in Dumariya P.S. Case No. 33 of 2016.
