This application for anticipatory bail arises out of Sahodara P.S. Case No. 47 of 2017, disclosing the offence under Sections 366-A/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner was not named in the FIR, which was registered on 05.06.2017 for the occurrence alleged to have taken place on 27.04.2017 since when the informant's daughter was found missing. Petitioner's name has surfaced in the statement of the victim recorded under Section 164 of the Cr.P.C. wherein she has named the petitioner and one Tabrej as the persons who had kidnapped her. Tabrej Akhtar has been allowed anticipatory bail by this Court vide order dated
Patna High Court CR. MISC. No.43208 of 2019(4) dt.27-09-2019 2/2 20.05.2019, passed in Cr. Misc. No. 33171 of 2019. Considering the facts and circumstances, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned CJM, West Champaran at Bettiah in Sahodara P.S. Case No. 47 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
