The petitioner in the present case is seeking regular bail in connection with Gopalganj (Town) P.S. Case No. 161/2017 registered for offences punishable under Sections 379/411 of the Indian Penal Code.

Learned counsel for the petitioner refers the First Information Report and submits that the petitioner is said to have been arrested when he was committing an act of theft. He would further submit that the petitioner has no criminal antecedent, he is innocent and is not mentally fit, therefore, he has been falsely

Patna High Court Cr.Misc. No.28527 of 2017 (2) dt.06-07-2017 2/2 implicated in the present case. The petitioner is in custody since 01.05.2017.

Considering the facts and circumstances of the case, let the petitioner, namely, Santosh Pardhan, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj (Town) P.S. Case No. 161/2017.
