2. The petitioner seeks regular bail in connection with Tikapatti P.S. Case No. 62 of 2026 lodged on 08.04.2026, for the offence punishable under Section 109 of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against the sole petitioner with allegation that he has attacked the informant's son by cricket bat on his head and leg with a view to kill him due to which the informant's son sustained injury and subsequently referred to GMCH, Purnia and later on, referred to PMCH, Patna, where his treatment is going on.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner has clean antecedent and he is in judicial custody since 24.04.2026. Counsel submits that on previous occasion, case diary along with the injury report of the victim have been called for. He further submits that according to his information, there was only one injury found which was simple in nature caused by hard and blunt substance.

Learned APP for the State opposes the prayer for bail of the petitioner but fairly submits that the case diary particularly its para 124 indicates that the injury to the victim was simple in nature caused by hard and blunt substance. He further submits that the injury report of the victim by Refferal Hospital Rupauli, Purnea is attached which also indicates that the injury was simple in nature caused by hard and blunt substance. He also submits that as per the injury report of the PMCH, Patna, no visible external injury has come.
6. As such, in the present facts and circumstances of the case considering that the petitioner is in judicial custody since 24.04.2026, let the above named petitioner be granted bail on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S.,
