JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 19-01-2016 After having argued the matter at some length, in presence of the learned SC-22 appearing on behalf of the respondent nos. 1 to 5, the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the present writ petition with a liberty to approach the Revenue Officer in terms of Section 14-A of The Bihar Bhoodan Yagna Act, 1954 ( in short 'Act, 1954') for redressal of his valid grievances with respect to the lands in question as also with respect to the issues raised in the present writ petition.

Permission is accorded.

The writ petition stands disposed of as withdrawn with the liberty aforesaid.

Patna High Court CWJC No.10545 of 2015 (2) dt.19-01-2016 If an appropriate petition is filed on behalf of the petitioner in the prescribed format before the Revenue Officer under Section 14-A of the Act, 1954, after impleading all the necessary parties, within a period of one month from today, then the Revenue Officer shall be obliged to consider and decide the claim of the petitioner by a reasoned and speaking order, after giving an opportunity of hearing to all concerned including the petitioner and the private respondent no. 8, at an early date, preferably within a period of four months from the date of filing of such application by the petitioner.

The parties shall be at liberty to raise all the issues of facts and law before the Revenue Officer, which may be available to them, with respect to the lands in question.

The writ petition stands finally disposed of with the observations and directions made above.
