The petitioner seeks bail in connection with Bhabua P.S.Case No. 239 of 2016 for the offences punishable under Sections 379 and 411/34 of the Indian Penal Code. The prosecution story, in brief, is that the motorcycle of the informant which was parked in front of his shop was being stolen by two boys in the evening. He raised alarm and chased them and the shopkeepers of the neighborhood caught the petitioner along with the motor cycle but another person escaped away. Thereafter he was handed over to the police. Earlier the prayer for bail of the petitioner was rejected vide Cr. Misc. No. 20892 of 2016 dated 21.07.2016 with

Patna High Court Cr.Misc. No.44237 of 2016 (3) dt.23-11-2016 2/2 an observation for the present. In the light of the said observation this is second attempt for grant of bail. The petitioner is in custody since 12.04.2016.The case is triable by the magistrate and he has remained in custody for more than seven months. A report was called for from the trial court regarding the stage of the case. It has been reported that the charges have been framed in this case. On behalf of the State it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua in Bhabua P.S.Case No. 239 of 2016, G.R.No. 980 of 2016.
