Petitioners seek regular bail in connection with Puraini P.S. Case No.103 of 2016 registered for the alleged offences under Sections 30 (a)/30 (d) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, two liters of country made liquor is said to have been recovered from the door of the Birendra Sahni (petitioner no.1) while the petitioner no.2 happens to be his wife.
It has been submitted by learned counsel for the petitioners that the petitioners are innocent and have committed no offence. They have been falsely implicated in this case. There is no recovery from the conscious physical possession of the
Patna High Court Cr.Misc. No.28935 of 2017 (02) dt.03-07-2017 2/2 petitioners. There is no specific allegations against the petitioners but the allegations are general and omnibus in nature. They have been languishing in jail custody since 25.04.2017. In the facts and circumstances of the case, the petitioners above named are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, Udakishunganj, Madhepura in connection with Puraini P.S.
