The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 36 and 41 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 3562.5 litres of liquor was recovered from a truck and the driver namely Altaf Khan was taken into custody. It is further stated that co-accused Kamlesh Kumar who was the liner was also arrested by the police and he disclosed the name of the other accused including the petitioner herein.

It is submitted by learned counsel for the petitioner that the said Kamlesh Kumar has been enlarged on bail vide order dated 22.3.2021 passed in Cr. Misc. no. 1994 of 2021. Petitioner is in custody since 22.7.2021 and charge sheet has

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner being in custody for the last 7 months and grant of bail to coaccused Kamlesh Kumar on whose confessional statement the name of the petitioner transpired, the Court directs the petitioner to be enlarged on bail in connection with Garkha P.S. Case no. 458 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl.
