ANJANA MISHRA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are apprehending their arrest in connection with Tr. No.3519 of 2014, arising out of Complaint Case No.C 2511 of 2012 for allegedly having committed the offences under Section 448, 323, 354 of the Indian Penal Code and Section 3/4 of the Prevention of Witch (Daain) Practices Act.

Learned counsel for the petitioners submits that the present case is an outcome of another complaint case, which

Patna High Court Cr.Misc. No.33022 of 2015 (2) dt.21-08-2015 2/2 has been instituted earlier by the petitioners' side and there is a history of land disputes between the parties. Considering the nature of allegations made in the present complaint petition, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri D. Kumar, learned Judicial Magistrate, 1st Class, Sadar, Motihari, District-East Champaran, in connection with Tr. No.3519 of 2014, arising out of Complaint Case No.C 2511 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
