JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-07-2017 Heard learned counsel for the petitioners, the learned Addl. P.P. for the State and the learned counsel for the informant. The petitioners seek regular bail in connection with Asthawan P.S. Case No. 80 of 2017, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 325, 307, 354(B) of the Indian Penal Code and Section 27 of the Arms Act. The accusation levelled is with regard to one Balmukund Paswan and several other persons having attacked the informant and his family members when the informant was protesting by blocking the road regarding death of his brother in a road accident.

No.28957 of 2017 (2) dt.01-07-2017 2/2 So far as the accusation with regard to the petitioner is concerned, it is submitted by the learned counsel for the petitioner that no specific allegation of any overt act has been levelled against him and he has clean antecedent. It is further submitted that the petitioner is in custody since 25.04.2017. Having regard to the facts and circumstances of the case, specifically in view of the fact that there is general and omnibus allegation against this petitioner, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Nalanda at Biharsharif in connection with Asthawan P.S. Case No. 80 of 2017.
