JUSTICE SUDHIR SINGH ORAL ORDER 20-05-2015 The petitioner is apprehending his arrest in connection with Vaishali(Belsar O.P.) P.S. Case No. 132 of 2014 for the offences instituted under Sections 323, 379, 498(A), 406 of the Indian Penal Code and 3⁄4 of the D. P. Act.

Heard learned counsel for the petitioner and the State. However, when the case was called out, no one was appearing on behalf of the complainant.

The prosecution story, in brief, is that the informant's daughter, namely, Priyanka Kumari, was married with this petitioner Sujeet Kumar and after marriage she went to her Sasural where the petitioner and other accused persons started demanding a Hero Honda Motorcycle in dowry and due to non-fulfillment of

Patna High Court Cr.Misc. No.48482 of 2014 (3) dt.20-05-2015 2 / 3 said demand, she was subjected to torture and cruelty in various ways and lastly the daughter of the informant was ousted from her matrimonial home by the accused persons after snatching all her belongings.

It has been submitted on behalf of the petitioner that the petitioner is ready to keep the complainant but she is not willing to stay with this petitioner. It has further been submitted that the petitioner is ready to deposit amount of Rs. 1500/- per month in the court below which shall be released in favour of the complainant.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the fact that the petitioner is ready to deposit Rs. 1500/- per month in the court below which shall be released in favour of the complainant, let the above named, petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of eight weeks from today in connection with Vaishali (Belsar O.P.) P.S. Case No. 132 of 2014, arising out of Complaint Case No. 3754 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
