The petitioners seek bail in complaint case no. 2181 © of 2018 instituted for the offence under Section(s) 448, 451 and 380 of the Indian Penal Code.
Learned counsel for petitioners has submitted that instant case has been filed by son of the tenant against the
Patna High Court CR. MISC. No.37929 of 2019(2) dt.21-06-2019 2/3 landlord and other persons as named in the complaint petition. It is alleged in the complaint petition that on the date of occurrence complainant got information from a call on his mobile that some persons have entered into his workshop after breaking the lock. The complainant came to know that his landlord and his associates had entered into his workshop after cutting the lock and took away valuable articles wroth Rupees one lakh.
Learned counsel for petitioner submits that complainant is not an eye witness to the occurrence. He has merely raised suspicion against these petitioners. The case has been filed to harass them because litigation are going on between the tenant and the landlord. Learned counsel further submits that landlord of the premises has already been granted bail by co-coordinate Bench of this Court by order dated 20.06. 2019 passed in Cr. Misc. no. 37146 of 2019 Petitioners are in custody since 4.5.2019 Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the JM 1st Class, Patna in connection with complaint case no. 2181 © of 2018 subject to
Patna High Court CR. MISC. No.37929 of 2019(2) dt.21-06-2019 3/3 the condition that both the bailors shall be the close relative of the petitioners.
