Petitioner, who is in custody, seeks bail in connection with Bajpatti P.S. Case No. 33 of 2018 registered for the offences punishable under Sections 34, 323, 504 and 376/34 of the Indian Penal Code and under Sections 4, 8 and 12 of POCSO Act.

It has been submitted on behalf of the petitioner that he is innocent and is maternal uncle of informant and has committed no offence. He has been falsely implicated in this case as his nephew refused to marry informant after having affair with her. He has no criminal antecedent. He is in custody since 13.02.2018.

Considering the aforesaid fact and circumstances of

Patna High Court Cr.Misc. No.39525 of 2018(3) dt.13-09-2018 2/2 the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special-Judge, Sitamarhi in connection with Bajpatii P.S.
