Petitioner apprehends his arrest in a case registered under sections 498A, 307/34 of the Indian Penal Code. And 3⁄4 of the Dowry prohibition Act.
According to the prosecution case it appears that the present case was instituted on the basis of complaint petition filed by the complainant in which it has been alleged that the marriage of the complainant was solemnized on 28.02.2010 with the petitioner. In the marriage Rs. 5,ooooo/- cash was given for expenditure two lac rupees were given for furniture and cloths.
Patna High Court Cr.Misc. No.29568 of 2015 (2) dt.28-07-2015 2/3 The complainant went to her matrimonial house. The family members of matrimonial house kept well for one year. One daughter was born out of wedlock of her husband. After birth of the daughter they started to harass her. Mother in-n-law and her dewar were pressurizing to fetch mobile and sari. The petitioner and his father were pressurizing to bring a caw. Lastly she was forced to leave her house. On behalf of the petitioner it has been submitted that petitioner has no criminal antecedent. It is further submitted that petitioner is ready to deposit Rs. 1000/- (one thousand) per month in the court below which shall be released in favour of the complainant.
On behalf of the State it is submitted that the petitioner is named in the complaint petition. Considering the aforesaid facts, it is directed that petitioner shall deposit an amount of Rs. 1000/- per month in favour of the complaint in the court below which shall be released in favour of the complainant, thereafter the above named petitioner in the vent of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten
