JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-04-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Petitioner apprehends his arrest in Jehanabad P.S. Case No.151 of 2021, registered for the offences punishable under Sections 147, 341, 323, 324, 307, 354 and 504 of the Indian Penal Code.

The informant alleged that in the evening of 24.02.2021 he along with his sister went to Jehanabad to attend a birthday party. Between 9.30-9.45, when they were returning, Kislay Kumar came with 10-12 unknown friends and made comment of his sister. In the meantime, the police came pacified the matter and the informant and his sister reached their home. Thereafter Kislay Kumar, his father, Anil Kumar, Ravi Kumar and 10-12 unknown persons various armed with Katta, knife

Patna High Court CR. MISC. No.50119 of 2021(2) dt.29-04-2022 2/3 and danda came and started abusing the informant. When the informant protested, they assaulted the informant with butt of Katta. In the meantime, Kislay Kumar gave knife blow on the back of the informant and thereafter all accused persons fled away.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. No specific overt act is alleged against the petitioner. The specific overt act is alleged against Kislay Kumar who gave knief blow on the back of the informant. It is lastly submitted that the petitioner has got no criminal antecedent as stated in paragraph 3 of the bail application. The learned APP for the State opposes the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts that no specific overt act is alleged against the petitioner, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No.151 of
