2. The petitioner has prayed for bail in connection with Manihari P.S. Case No.84 of 2026 registered for the offence punishable under Section 69 of the BNS.

3. The case of the prosecution, in short, is that the petitioner has established physical relationship with the informant for last one year on false promise of marriage. As the informant pressurized him for marriage, he denied and abused her.

4. Learned counsel appearing on behalf of the petitioner has submitted that from perusal of the FIR itself it is clear that physical relationship between petitioner and informant continued for a year. Despite that the informant did not complained. The informant is aged about 20 years and as per the FIR, on 15.03.2026 the informant was being abused and the petitioner

Patna High Court CR. MISC. No.42079 of 2026(2) dt.30-06-2026 2/2 denied to marry her, then also she has filed this case on 20.03.2026; after a delay of five days. Learned counsel for the petitioner has submitted that it is a case of relationship between two adults and breakup thereafter. Learned counsel for the petitioner has submitted that it is case of district Katihar and in the districts of Katihar, Purnea and Araria, this kind of allegations are rampant. It has lastly been submitted that the petitioner is having no criminal antecedent and he is in judicial custody since 01.04.2026.

5. The application for bail is opposed by learned counsel for the Informant.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the court of learned Chief Judicial Magistrate, Katihar in connection with Manihari P.S. Case No.84 of 2026.
