The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 290, 272, 273, 420 of the Indian Penal Code and 47(a) of Excise Act. Kamlesh Kumar Singh and Rohan Kumar Singh were apprehended when 160 bottles of country made liquor 200 ml. each were recovered and on their indication the house of one Gandhi Singh @ Ram Niwas Singh was also raided from there 150 bottles of country made liquor 200 ml. each were recovered. The apprehended accused suggested that the petitioner used to collect empty bottles of country made liquor and refill it.

No.34602 of 2015 (2) dt.25-08-2015 2/2 It is submitted by learned counsel for the petitioner that except confession of the co-accused no material has been collected has been collected against the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 71 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
