The petitioner has filed the instant application for grant of regular bail in connection with Ballia P.S. Case No. 50 of 2022 registered under Sections 392 and 34 of the Indian Penal Code.

Prosecution case in nutshell is that when informant along with their associates were returning from the work of videography, in the meantime, some miscreants came on bike and on pistol point snatched camera from the informant and also they opened fire.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. The name of the

It is further submitted that no recovery of stolen article has been found from the possession of the petitioner and there is no material to show the involvement of the petitioner in the present case except the disclosure made to the informant by the villagers assembled at the place of occurrence. Petitioner is languishing in judicial custody since 27.02.2022. The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Ballia P.S. Case No. 50 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
