The petitioner seeks bail in Sultanganj P.S. case No. 180 of 2012 under Section 302, 427, 34 of the Indian Penal Code. The informant alleged that he got information that his brother Niraj Kumar was lying injured in Referral Hospital, Sultanganj. The informant went there and, on enquiry, came to know that Arvind Yadav, Bipin Yadav, Rikka Yadav, the petitioner, and Ramesh Singh assaulted his brother when his brother did not give pass to the bus of Arvind Yadav. His brother, Niraj Kumar, died during the course of treatment. The learned counsel for the petitioner submits that Arvind Yadav has already been granted anticipatory bail vide order passed in Cr. Misc. No. 16125 of 2013 by a coordinate

Patna High Court Cr.Misc. No.27793 of 2017 (2) dt.28-06-2017 2/2 Bench of this court. Bipin Yadav, cleaner of the bus, has also been granted regular bail vide order dated 01.10.2013 passed in Cr. Misc. No. 41226 of 2013 and the case of petitioner stands on same footing as that of two other accused persons. It is submitted that the deceased died out of road accident.

Considering the facts aforesaid and the fact that similarly situated accused Arvind Yadav and Bipin Yadav have already been enlarged on bail and the case of petitioner stands on the same footing, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Bhagalpur in Sultanganj P.S.
