JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-03-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Madanpur P.S. Case No. 88 of 2020, registered for the offence punishable under Sections 302, 307 and other allied sections of the Indian Penal Code. As per the FIR, this petitioner is alleged to have assaulted Navin Kumar Singh with Pasuli on his neck and when he fell down this petitioner shot on his neck causing his death. It is submitted on behalf of the petitioner that there is case and counter case for the same occurrence. Several persons from both sides received injuries. As a matter of fact, the occurrence took place due to land dispute between the parties. Petitioner is in custody since 04.12.2020. Investigation is

Learned APP however, vehemently opposed the prayer for bail and submitted that petitioner is the assailant of deceased and there is specific and direct allegation of causing gunshot injury to the deceased against this petitioner. Considering the nature and gravity of offence, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

However, as the petitioner is in custody since 04.12.2020 trial court is directed to expedite the trial. (Prabhat Kumar Singh, J) vinita/- U T
