JUSTICE SANJAY PRIYA ORAL ORDER 19-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Noorsarai P.S. Case No. 284 of 2016 corresponding to Sessions Trial No. 322 of 2017 instituted for the offence under Sections-302/34 of the Indian Penal Code and 27 of the Arms Act.

It has been submitted on behalf of the petitioner that other co-accused Adhir Yadav whose name has been disclosed by co-accused Ranjeet Kumar Yadav in his confessional statement has already been granted bail by this court vide order dated 03-052017 passed in Cr. Misc. No. 19094 of 2017. The petitioner is not named in the written report. As per written report, Sharda Yadav fired and thereafter, co-accused Dinesh Yadav fired which hit on the arm of Mukhiyajee and caused injury to Mukhiyajee and

Patna High Court Cr.Misc. No.30730 of 2017 (3) dt.19-07-2017 thereafter, Shravan Kumar and Kamlesh Yadav caused injury on waist of Mukhiyajee with fire arm.

As such, there is no allegation of overt act against this petitioner.

In such circumstances, prayer for bail is allowed and it is ordered that the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Noorsarai P.S. Case No. 284 of 2016 corresponding to Sessions Trial No. 322 of 2017 to the satisfaction of Learned Additional District & Sessions Judge-III, Nalanda at Bihar Sharif subject to condition that both the bailors should be relatives of the petitioner.
