The petitioner seeks bail in connection with Halsi P.S. Case No. 14 of 2023 registered for the offences punishable under Sections 147, 148, 149, 341, 302 and 504 of the Indian Penal Code.
As per the prosecution case, the petitioner and the co-accused persons are alleged to have stopped the informant's son and threatened to kill. Satendra Paswan also assaulted on the head of the informant's son with khanti. The co-accused persons surrounded him and assaulted him with lathi, danda, bricks and stones causing severe injuries and he died during the course of treatment.
Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.41716 of 2023(2) dt.14-07-2023 2/2 that the petitioner is innocent and has falsely been implicated in this case. There is specific allegation against Satyendra Paswan of assaulting the son of the informant. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has got clean antecedent and is in custody since 21.01.2023.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the aforesaid facts, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-III, Lakhisarai in connection with Halsi P.S.
