The petitioner seeks bail in Chand P.S. case No. 34 of 2017 under Section 37(a) of the Bihar Prohibition and Excise Amendment Act, 2016.
The police intercepted the petitioner and from his possession one country made pistol without any cartridge was recovered. The petitioner was found in drunken stage and smell of alcohol was coming out.
It is submitted that no ammunition was recovered from the possession of the petitioner and for recovery of one country made pistol the petitioner is in jail since 09.02.2017. The petitioner has already remained in jail for about four and half months.
Patna High Court Cr.Misc. No.27773 of 2017 (2) dt.28-06-2017 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Kaimur at Bhabhua in Chand P.S. Case No. 34 of 2017.
