The petitioner, who is in custody, seeks bail in connection with Alauli P.S. Case No. 143 of 2017 registered for the offence punishable under Sections 363, 366(A), 34 of the Indian Penal Code.
Informant is the mother of victim, who in her written complaint has stated that her daughter Guriya Kumari, aged about 16 years had gone to market for purchasing on 18.05.2017 at about 6.00 PM the petitioner and other family members seduced her to marry and took her and it is further alleged that the victim herself returned to her house and made statement before the Magistrate under Section 164 Cr.P.C. She
Patna High Court Cr.Misc. No.38421 of 2018(3) dt.24-08-2018 2/2 was medically examined by the Medical Board and Medical Board has assessed her age between 17-18 years. However no sign of committing any sexual assault on the victim was found by the Medical Team. It has been submitted that petitioner has been falsely implicated in this case and he has no criminal antecedent and is in custody since 15.03.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Alauli P.S. Case No. 143 of 2017.
