The petitioner seeks bail in connection with Economic Offences Police Station Case No.25 of 2012/G.R. No.5281 of 2012 registered under Sections 466, 467, 468, 471, 419, 420 and 120(B) of the Indian Penal Code besides Sections 66 and 72 of the Information Technology Act, 2000.
The accusation is that on receiving secret information about gathering of some persons in a rented house situated at Mohalla-Rajiv Nagar, Patna, for disbursing the answers of the questions of the S.S.C. Examination, which was fixed to be held
Patna High Court Cr.Misc. No.27748 of 2017 (4) dt.04-10-2017 2/3 on 22.10.2012, the informant being the Officer Incharge of Economic Offences Police Station, Patna, alongwith other police officials reached there and apprehended 17 persons including Banti Kumar alias Dhiraj Kumar with laptop, mobile and other electronic instruments alongwith Admit-cards of the several candidates appearing for the S.S.C. Examination, who confessed that they are present to disburse the answers to the questions of the S.S.C. Examination.
Learned counsel appearing on behalf of the petitioner submits that after 21⁄2 years of the lodging of the present case, the Investigating Officer raised suspicion against the petitioner as the petitioner used to run the Coaching Centre. Except that, nothing has been collected by the Investigating Officer against the petitioner. The petitioner is in custody since 06.02.2017 and, on investigation, the chargesheet has already been submitted against the petitioner.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Patna, in connection with Economic Offences Police Station Case No.25 of 2012/G.R.

Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
