JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-09-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and the learned APP for the State Mr. Mrityunjay Kr. Nirala. At the outset, the learned counsel for the petitioner submits that by mistake, paragraph No. 6 has been incorrectly mentioned in the present petition, hence he prays that it be directed to be treated as deleted from the present petition.

Patna High Court CR. MISC. No.50870 of 2021(2) dt.08-09-2021 2/3 Accordingly, it is directed that paragraph no. 6 shall be deemed to have been deleted from the present petition. The present petition has been filed seeking modification of the order dated 02.06.2021, passed in Cr. Misc. no. 39520 of 2020 to the extent that the time granted to the petitioner for surrendering before the learned court of Chief Judicial Magistrate, Darbhanga in connection with Sadar PS case no. 208 of 2020, be extended by a further period four weeks from today.

The learned counsel for the petitioner has submitted that on account of illness, the petitioner could not surrender within the stipulated time but he undertakes to surrender within a period of four weeks from today.

The learned APP for the State has got no objection. Having heard the learned counsel for the parties and having considered the submissions made in the present petition, this Court deems it fit and appropriate to extend the time granted to the petitioner to surrender before the learned court of Chief Judicial Magistrate, Darbhanga in connection with Sadar PS case no. 208 of 2020, by a further period of four weeks from today in order to enable the petitioner to surrender before the

Patna High Court CR. MISC. No.50870 of 2021(2) dt.08-09-2021 3/3 Ld. Court below to avail the privilege of bail. The petition stands disposed of with the aforesaid modification in the order dated 02.06.2021, passed in Cr. Misc. no. 39520 of 2020.
