The petitioner seeks bail in a case registered for the offence punishable under Sections 406, 420, 468, 447 & 506/34 of the Indian Penal Code.

As per the prosecution case, the petitioner is said to have distributed booklet in different districs of Rs.80,0000, but he did not return. He wrongly posted post in facebook. He also threatened the informant.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather

Patna High Court CR. MISC. No.38031 of 2020(3) dt.05-03-2021 2/2 general and omnibus in nature. As a matter of fact, when the petitioner sent a pleader notice to the informant for payment of entire arrears i.e. Rs.24,0000/- on 30.07.2020, then to save his skin the informant has lodged this false and frivolous case against the petitioner. The petitioner has no criminal antecedent and has been languishing in custody since 23.07.2020. Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Jogsar) P.S. Case No.377 of 2020.
