The petitioner seeks bail in Pirbahore P.S. Case No. 35 of 2017, registered under Section 25(1-b) a, 26/35 of Arms Act, and Section 30(a) of Bihar Excise Act Amended 2016. As per the prosecution case, One Royal stag bottle of wine having 375 ml and 4 live cartridges were recovered from the petitioner.

It is submitted by learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner. Petitioner was arrested on 01.02.2017 but he was not produced in present case but remanded on 28.02.2017 since then

Patna High Court Cr.Misc. No.28857 of 2017 (2) dt.03-07-2017 2/2 he is in custody.

Considering the facts aforesaid, the above named petitioner is directed to enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Special Judge, Excise, Patna in connection with Pirbahore P.S.
