====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 20-06-2017 Heard both sides.

The petitioner seeks bail in Bhabua P.S. Case No. 623 of 2016 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The informant alleged that while he along with his brother Md. Farid Mansuri were returning from Bhabua, Uttam Patel caught his brother and Chhattis Singh, Nilesh Kumar, Arvind Kumar, Mannu Pandey the petitioner, Rohit Singh and Radhe Shyam Singh indiscriminately assaulted his brother with iron rod and Lathi. Brother of the informant died on the spot and the accused persons fled away having the dead body. Learned counsel for the petitioner submits that no specific allegation of assault is made against the petitioner. Altogether seven persons are named in the FIR and same and

Patna High Court Cr.Misc. No.20477 of 2017 (3) dt.20-06-2017 2/2 similar allegation is made against all the accused persons. Arvind Kumar @ Arvind Kumar Singh has been granted bail vide order passed in Cr. Misc. No. 8582 of 2017 by a coordinate Bench of this Court. Similarly Neta Patel @ Nitish Patel @ Netash Patel @ Nitish Kumar Patel and one another have also been granted bail vide order passed in Cr. Misc. No. 10034 of 2017. The case of the petitioner stands on the same footing. Rohit Singh @ Rohit Patel has also been granted bail.

Considering the facts aforesaid and the facts that similarly situated co-accused have already been granted bail and the case of the petitioner stands on the same footing as that of Rohit Singh @ Rohit Patel and Neta Patel @ Nitish Patel @ Netash Patel @ Nitish Kumar Patel, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur (Bhabua) in Bhabua P.S.
