JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-06-2022 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in a case registered for the offence punishable under Section 323 and other allied sections of the Indian Penal Code.

Prosecution's case in short is that the petitioners, abused and assaulted the informant and his family members. They used to show their private parts to them. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Petitioners are agnate and they have

Patna High Court CR. MISC. No.50386 of 2021(4) dt.23-06-2022 2/2 pending land dispute between them and only to put pressure and settle the dispute, informant has made false accusation against them. Sister of the petitioners had earlier lodged a case against the informant side (Annexure 2).

Learned counsel appearing for the State as well as the informant oppose the prayer for bail. They submit that there is allegations against the petitioners that they abused and assaulted the informant and his family members. They used to show their private parts to them.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in K.Hat Police Station Case No. 492 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
