JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 467,468,469,471,420 and 120B/34 of the Indian Penal Code. The prosecution case is that the petitioners applied for a loan for purchase of tractor from Syndicate Bank, Chapra branch wherein forged Khatian and land possession documents with regard to 124 bighas of land were submitted whereas it was found that the petitioners have only 26 bighas of land. It is submitted by the learned counsel for the petitioners that for obtaining loan for purchase of the tractor even 26 bighas of land is enough. More over, on the basis of forged land

Patna High Court Cr.Misc. No.37090 of 2015 (2) dt.14-09-2015 2/2 possession certificate neither any loan was disbursed nor the petitioners took any advantage of the same. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Chapra Town P.S. Case No.235 of 2008 subject to the conditions as laid down under Section 438(2) Cr.P.C.
